Ski Canada magazine’s 40th Anniversary Sweepstakes Contest
Official Rules
1. The “Contest Period” starts at 12:01 am on 1 September 2011 and continues until 11:59 pm on 28 February 2012 (the “Contest Closing Date”), Eastern time. No purchase necessary.
2. Sponsor: This contest is sponsored by Solstice Publishing Inc., publisher of Ski Canada magazine and www.skicanadamag.com (hereinafter “Ski Canada”).
3. Eligibility: This contest is open to Canadian residents, excluding those resident in the province of Quebec, who, at the time of entry, have reached the age of majority according to the law of the province or territory in which they reside AND who have correctly answered a skill-testing question. In order to be eligible to be entered into this contest participants must respect all conditions set forth in the relevant promotional material. The following are excluded from entering: employees of Ski Canada or its suppliers and clients, their immediate family, or persons working for any company involved in any phase of contest administration and persons with whom they are domiciled. The contest is subject to all applicable federal, provincial and municipal laws and regulations, and is void where prohibited.
4. How to Enter: There will be two processes for selecting entrants as potential prize-winners:
(a) For thirty (30) of the forty (40) total prizes, all active paying subscribers to Ski Canada magazine at the time of each draw will be automatically entered, as will all who are current recipients of Ski Canada’s monthly e-newsletter, and all who follow Ski Canada magazine through its Facebook and Twitter social media connections. Contestants may also enrol in the Sweepstakes by providing their name and contact information online at www.skicanadamag.com/contests. There will be four (4) of these random draws, each time selecting multiple potential prize-winners, to be held on 14 October 2011, 1 December 2011, 12 January 2012, and 29 February 2012, and the selected entrants will be notified within 48 hours of each of these scheduled draws.
(b) Five (5) of the 40 total prizes will be awarded through to followers of facebook.com/SkiCanadaMag, and another five (5) prizes prizes will be awarded to followers of twitter.com/SkiCanadaMag. These ten prizes will be awarded at various times and in various ways during the Contest Period, at the whim of Ski Canada, with no predetermined dates.
To be declared a winner, selected contestants must first correctly answer, unaided, a time-limited mathematical skill-testing question posed by telephone at a mutually agreeable time, and must confirm their eligibility according to the criteria outlined above. Each selected contestant must also allow his or her name, city of residence, and photo to be used by Ski Canada for promotional purposes without further notice or compensation, and may be required to return a signed release of liability and acknowledgement form. If a selected contestant cannot be reached, OR is deemed ineligible, OR does not correctly answer the skill-testing question, OR does not agree to the terms of the contest, the next eligible contestant will be chosen as the winner.
Contest judges’ rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
5. Prizes: Forty (40) prize-winners will be selected during the contest period, for forty (40) different prizes. The list of prizes (including one Grand Prize) is published in Ski Canada magazine’s Buyer’s Guide 2012 issue, and on Ski Canada’s website, at skicanadamag.com/contests. All prizes must be accepted as awarded and may not be transferred or exchanged, and the prizes have no cash value. Ski Canada reserves the right to substitute a prize of at least equal or greater value in the event of the unavailability, for whatever reason, of the advertized prize.
7. Odds of winning: The odds of winning depend on the number of eligible entries received. No attempt will be made to ensure that the list of contestants excludes duplicate entries, and it is assumed that some contestants will be entered more than once, due to their multiple relationships with Ski Canada and its online properties.
8. Ski Canada is collecting personal data about entrants for the purpose of administering this contest. No further informational or marketing communications will be received by entrants unless entrants provide Ski Canada with explicit permission to do so as indicated on the entry form. Please see Ski Canada’s Privacy Policy at skicanadamag.com/privacy.
9. By entering this contest, entrants release and hold harmless Ski Canada, its advertising and promotional agencies and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this contest or, if declared a winner, the prize. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release.
10. This contest will be run in accordance with these rules, subject to amendment by Ski Canada. Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the contest. The terms of this contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
11. (a) All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Ski Canada. Ski Canada takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Ski Canada is not responsible for any errors or omissions in printing or advertising this contest. All entries become the property of Ski Canada and will not be returned. Ski Canada assumes no responsibility for failure of the postal system, internet or the website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Ski Canada reserves the right, in its sole discretion, to cancel or suspend the email portion of this contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Ski Canada reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
(b) If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the contest server machine(s).
